|
1. If credit is extended to the customer, our payment terms are net thirty.
2. We will ship from 10% under to 10% over the quantity ordered and invoice the quantity shipped at the quoted price.
3. All artwork, computer files and programs, film, tools, dies, and fixtures used in the processing of your order will remain the property of Decorated Products Inc. Decorated Products Inc. may charge for artwork, prep, tooling, etc. and these charges are for the adaptation of existing artwork or fixtures in order to run your custom order. Decorated Products Inc. will maintain these items for our use in processing future orders, for the reasonable life of that artwork or tooling. If they become worn and unusable, Decorated Products Inc. may ask the customer to pay for these items again, for their next useful life. Ownership of artwork and tooling remains with Decorated Products Inc.
4. Any artwork, tool, fixture, or files for customer orders are maintained for five years after the last order. Customers may need to be charged for updating obsolete artwork, fixtures, and tooling after that time.
5. All orders are shipped f.o.b. Westfield, Massachusetts, unless otherwise stated.
6. Any complaints or objections to an order must be brought to the attention, in writing, of Decorated Products Inc. within 30 days of receipt of order.
7. Any returns must be marked with a Return Materials Authorization (RMA) number, issued at the time of the customer complaint. Our Receiving Department will not accept returns without an RMA number.
8. If an order is rejected for any reason deemed to be the fault of Decorated Products Inc., the full order must be returned for replacement. If other disposition of the order is to be made, it will be done so only with the express permission of Decorated Products Inc.
9. Decorated Products Inc. reserves the right to re-process or otherwise repair any rejected order within the time taken to produce the original order, or within standard lead times, whichever is longer. Decorated Products Inc. is not responsible for penalties or any other cost associated with the product unless specifically agreed upon.
10. Decorated Products is expressly not responsible for any late charges or charge backs incurred by our customers for late delivery or any other issue affecting the end customer, unless there is a separate agreement to this effect, signed by both parties.
11. Cancellation charges will be calculated on the stage of processing at the time of cancellation with a minimum cancellation charge of $50.00.
12. If photographic proofs are submitted for the customer’s approval, the customer is responsible for the details of copy, layout, etc. regardless of any deviation from blueprints or preliminary material submitted.
13. Restocking charge: If the customer returns a part that is not custom, and can be sold to others, the customer agrees to pay 10% restocking charge, and freight costs for both the delivery and return of the order.
14. Color on any product will be maintained with a tolerance of +/- one PMS (Pantone Matching System) value unless otherwise specified and agreed to in writing by Decorated Products Inc.
15. Decorated Products Inc. specifically will not authorize any payment for inspection of parts at a customer’s location.
16. These terms supercede all other Customer terms unless otherwise expressly agreed to in writing.
